These Terms of Use (“Terms”) govern the use of the website and online store operated by RUDCEF (the “Artist”, “I”, “me”, “my”) at https://www.rudcef.com (the “Site”).By accessing or using the Site, you (“User”, “you”) agree to these Terms. If you do not agree, you must not use the Site.

1. Purpose

These Terms set out the rights, obligations and responsibilities between the Artist and Users in connection with the use of the Site and the services provided through it, including the viewing and purchase of artworks, prints and related products.

2. Definitions

“Site” means the online website and store operated by the Artist to provide information and sell products.
“User” means any person who accesses the Site and uses the services, including Members and non-members.
“Member” means a User who has created an account on the Site and can continuously use the services provided.
“Products” mean artworks, prints, goods and any other items that the Artist offers for sale through the Site.

3. Posting and Changes to the Terms

I post these Terms on the Site so that Users can easily review them.
I may amend these Terms to the extent permitted by applicable law. When the Terms are amended, I will announce the amended Terms and their effective date on the Site in advance.
The amended Terms apply only to contracts concluded after the effective date. Contracts concluded before that date remain subject to the previous Terms.

4. Services Provided

Through the Site, I provide:

Information on artworks, prints and related products
Online ordering and payment services
Delivery and order management services
Other services that I may define or introduce in the future

I may change all or part of the services for operational or technical reasons and will announce such changes on the Site where reasonably possible.
I may temporarily suspend the services due to maintenance, system replacement, breakdown or other significant reasons.

5. Membership and Accounts

Users may create a Member account by providing the information requested by the Site and agreeing to these Terms.
Users must provide accurate and truthful information and keep it up to date.
Each Member is responsible for maintaining the confidentiality of their login ID and password and for all activities conducted under their account.
If a Member becomes aware of unauthorized use of their account, they must notify me without delay and follow any instructions I provide.

6. User Obligations and Prohibited Conduct

Users must comply with these Terms, applicable laws and all notices posted on the Site.

Users must not:

Provide false information when creating an account or placing an order
Use another person’s name, email address or payment information without permission
Infringe the intellectual property rights, privacy or other rights of the Artist or any third party
Upload or transmit content that is illegal, defamatory, obscene, hateful, threatening or otherwise inappropriate
Hack, attack, overload or otherwise disrupt the Site or its servers
Use automated tools (bots, scrapers, etc.) to collect data from the Site without permission
Engage in any other act that violates applicable laws or public order and morals

If I believe that a User has engaged in prohibited conduct, I may restrict or terminate that User’s access to the Site and, where necessary, take legal action.

7. Orders, Prices and Payments

When you place an order through the Site, you make an offer to purchase the selected Products from me.
A contract is formed when I confirm the order and send an order confirmation email or message.
Product prices, shipping fees and available payment methods are indicated on the Site and at checkout. I may change prices at any time, but such changes do not affect orders that have already been confirmed.
Payments are processed through third-party payment service providers (payment gateways). You must comply with any terms and conditions applied by such providers.

8. Shipping, Returns and Refunds

Shipping methods, fees, delivery times and related information are described in detail on the Shipping Info / 배송 안내 page of the Site.
Conditions and procedures for returns, exchanges and refunds are described on the Returns & Refunds / 교환·환불 안내 page.
If there is any discrepancy between these Terms and those detailed policies, the more specific policy may prevail.

9. Intellectual Property

Unless otherwise indicated, all copyrights and other intellectual property rights in the artworks, images, designs, photographs, texts, logos and other content on the Site belong to me as the Artist, or to the respective rights holders.
You may view the content for personal, non-commercial purposes only.

Without prior written consent from me or the relevant rights holders, you may not:

Reproduce, modify, distribute, publicly display, sell or license any content from the Site for commercial purposes
Use the artworks or content in connection with your own brand, products, NFTs, merchandise or promotional materials

Unauthorized use of the content may result in civil or criminal liability.

10. Limitation of Liability

The Site and all content are provided “as is” and “as available” without any express or implied warranties, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose or non-infringement.
To the maximum extent permitted by law, I am not liable for damages arising out of or in connection with:
Temporary unavailability or malfunction of the Site
Errors in information provided by Users
Problems caused by third-party services such as couriers, payment gateways or internet service providers
Use of the Site in violation of these Terms
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including certain consumer rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles.
If a dispute arises in connection with the Site or these Terms, you and I will first try to resolve it through good-faith discussions.
If a dispute cannot be resolved amicably, it may be brought before the competent court in Seoul, Republic of Korea, unless mandatory local law requires another jurisdiction.

작가는 관련 법령을 위배하지 않는 범위에서 본 약관을 개정할 수 있습니다.
약관을 개정하는 경우, 적용일자 및 개정 사유를 명시하여 개정 약관을 사이트에 사전에 공지합니다.
개정 약관은 적용일자 이후에 체결되는 계약에만 적용되며, 그 이전에 이미 체결된 계약에 대해서는 개정 전 약관이 적용됩니다.

작품, 프린트 및 관련 상품에 대한 정보 제공
온라인 상품 주문 및 결제 서비스

그 밖에 작가가 정하거나 도입하는 서비스

작가는 운영상·기술상의 필요에 따라 제공하고 있는 서비스의 전부 또는 일부를 변경할 수 있으며, 변경 시 그 내용을 사이트에 공지할 수 있습니다.
시스템 점검, 교체, 고장, 통신 장애 등의 사유로 인해 서비스 제공이 일시 중단될 수 있습니다.

5. 회원가입 및 계정 관리

이용자는 작가가 정한 절차에 따라 필요한 정보를 기재하고 약관에 동의함으로써 회원가입을 신청할 수 있습니다.

6. 이용자의 의무 및 금지행위

이용자는 관련 법령, 본 약관, 사이트 안내 및 공지사항을 준수해야 합니다.

이용자는 다음과 같은 행위를 하여서는 안 됩니다.

회원가입 또는 주문 시 허위 내용의 등록
타인의 명의, 이메일 주소, 결제정보 등을 무단으로 사용하는 행위
작가 및 제3자의 지식재산권, 초상권, 개인정보 등을 침해하는 행위
욕설, 비방, 음란, 혐오, 위협, 불법적인 내용의 정보 또는 문언을 게시·전송하는 행위
사이트 또는 서버를 해킹, 공격하거나 과부하를 유발하는 행위
자동화된 수단(봇, 크롤러, 스크래퍼 등)을 이용하여 사이트의 데이터를 무단으로 수집하는 행위
기타 관련 법령 또는 공서양속에 반하는 행위

이용자가 위와 같은 행위를 한 경우, 작가는 사전 통보 없이 서비스 이용을 제한하거나 회원자격을 상실시킬 수 있으며, 필요한 경우 민·형사상의 법적 조치를 취할 수 있습니다.

7. 주문, 가격 및 결제

이용자가 사이트를 통해 상품을 주문하는 경우, 이는 해당 상품을 작가로부터 구매하고자 하는 청약의 의사표시입니다.
작가가 주문을 확인하고 주문 확인 이메일 또는 메시지를 발송한 시점에 구매 계약이 성립합니다.
상품의 가격, 배송비, 결제수단 등은 사이트 및 결제 단계에서 표시되며, 작가는 이를 변경할 수 있습니다. 다만, 변경 전 이미 체결된 계약에는 변경된 사항이 소급 적용되지 않습니다.
결제는 전자지급결제대행사(PG사) 등 제3자 결제 서비스를 통해 처리되며, 이용자는 해당 서비스 제공자의 약관 및 정책을 준수해야 합니다.

8. 배송, 교환 및 환불

배송 방법, 배송비, 평균 배송기간 등의 상세 내용은 사이트의 배송 안내(Shipping Info) 페이지에 따릅니다.
교환 및 환불의 조건, 절차 등은 사이트의 교환·환불 안내(Returns & Refunds) 페이지에 따릅니다.

10. 책임의 제한

택배사, 결제대행사, 인터넷 서비스 제공업체 등 작가가 통제할 수 없는 제3자 서비스로 인한 문제
